Probate and Estate Administration

Upon death property must pass from the deceased to their family or other specified beneficiaries. If a will was in place before death, the deceased’s estate is generally probated through the local Circuit Court. If no will was executed before the person’s death, the estate will likely go through the estate administration process. The length and complexity of probate or estate administration depends on a variety of factors. Additionally, many pitfalls exists for those unfamiliar with the estate administration process. It is extremely important to seek legal counsel before undertaking the role of an executor or administrator.
